1. Introduction

Welcome to TutorXcel. By accessing our services, you agree to comply with these Terms & Conditions. These terms are designed to ensure a clear understanding of our tutoring services, policies, and expectations in compliance with New Zealand laws, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986, and the Privacy Act 2020.

2. Services Provided

  • TutorXcel provides subject-specific tutoring and coaching for students in Years 7-13

  • Sessions may be conducted in person or online, depending on the arrangement.

  • Our tutors are highly skilled and undergo necessary vetting, including New Zealand Police checks as required under the Vulnerable Children Act 2014.

3. Booking & Payment Policy

3.1 Booking Sessions

  • All tutoring sessions must be pre-booked in advance.

  • Sessions are scheduled based on availability of tutors and student needs.

  • Students must attend sessions on time to maximize their learning experience.

3.2 Payment Terms

  • Payment for sessions is required upfront unless otherwise agreed.

  • Accepted payment methods include bank transfer, credit/debit card, or online payment platforms.

  • Receipts will be provided for all payments.

3.3 Cancellations & Rescheduling

  • At least 24 hours' notice is required for cancellations or rescheduling.

  • Cancellations made less than 24 hours before the session may be charged at full session price.

  • If a tutor needs to cancel, a rescheduled session or refund will be arranged.

4. Student & Tutor Responsibilities

4.1 Student Responsibilities

  • Students are expected to engage actively in sessions.

  • Respectful behavior towards tutors and peers is required at all times.

  • Students must complete assigned work or practice to ensure progress.

4.2 Tutor Responsibilities

  • Tutors will provide high-quality, personalized tutoring.

  • Tutors will adhere to the Code of Conduct and maintain professional boundaries.

  • Tutors will respect student confidentiality and privacy, as per the Privacy Act 2020.

5. Code of Conduct

  • Respect & Professionalism: Students, parents, and tutors must maintain a respectful and professional attitude.

  • Safe Learning Environment: Any bullying, harassment, or discrimination will not be tolerated.

6. Privacy & Data Protection

  • TutorXcel complies with the Privacy Act 2020, ensuring all personal data is collected, stored, and used responsibly.

  • Student information is kept confidential and is not shared with third parties unless required by law.

  • Parents/guardians must provide consent for any data collection involving minors.

7. Liability & Disclaimer

  • While TutorXcel aims to provide high-quality tutoring, we do not guarantee specific academic outcomes.

  • TutorXcel is not responsible for any direct or indirect losses related to tutoring services.

  • Parents and students acknowledge that progress depends on effort, participation, and consistency.

8. Complaints & Dispute Resolution

  • Any concerns or complaints should be submitted via email to icstevenson@gmail.com.

  • TutorXcel will aim to resolve disputes promptly and fairly.

  • If a resolution cannot be reached, disputes may be referred to Consumer Protection under the Consumer Guarantees Act 1993.

9. Changes to Terms & Conditions

  • TutorXcel reserves the right to update these terms at any time.

  • Continued use of our services after updates constitutes acceptance of the new terms.
